These terms and conditions (“Terms and Conditions”) govern the relationship between Second Star Adventure, LLC d/b/a Second Star Adventure Co., its agents and affiliates (“Second Star”, “we”, “us”, or “our”) and you (“Client”, “traveler”, “you”, or “your”).  By using Second Star’s services, you agree to be bound by the Terms and Conditions. The Terms and Conditions include warranties, disclaimers, and limitations and exclusions of liability, and may restrict your rights and remedies against Second Star.

1. Agency Role

Second Star acts solely as a booking agent for certain suppliers, including hotels, cruise lines, tour operators, car rental companies, airlines, ground transportation, and other independent contractors (“Suppliers”). Second Star is not the source or provider of the Suppliers’ services, and is not responsible for any acts or omissions of the Suppliers. Suppliers are responsible for the services they provide. Each Supplier’s own terms and conditions apply to the services they provide. You agree not to hold Second Star responsible for any Suppliers’: a) failure to provide services; b) failure to comply with applicable law; or c) negligent acts or omissions giving rise to physical or financial harm, delay or inconvenience. We assume no responsibility for any wrongful or negligent acts or omissions by any other party not under our control.

Second Star will make reasonable efforts to inform you of updates to your travel, including relevant travel alerts, but it is ultimately your responsibility to inform yourself. 

2. Client Role

You warrant that you are at least 18 years of age and possess the legal authority to agree to these Terms and Conditions and to make travel bookings with Second Star. 

You warrant that all information supplied by you on behalf of yourself and any members of your traveling party is true and accurate. 

You agree that you will only make legitimate reservations or purchases with Second Star and its Suppliers, and acknowledge that, without limitation, any speculative, false, or fraudulent reservation is prohibited.

You agree to review and verify all information in any travel documents you receive. You agree to contact us within 24 hours of receiving any travel documents if any change or correction is required.

You agree to be financially responsible for all travel bookings made on behalf of you and any member of your traveling party, and to make all required payments when due.

You agree to bring any and all required identification documents with you when you travel (see 4. Travel Documents, below).

You agree to make an independent risk assessment of any travel destinations before your departure date.

You agree to abide by the terms and conditions of purchase imposed by any Supplier that you have selected as a service provider on an itinerary you have approved.

3. Payments, Changes and Cancellations

You are responsible for all charges related to your travel bookings made through Second Star, including any applicable fees, duties, taxes, and assessments. Each time you authorize a payment through Second Star, you agree to allow Second Star to use your authorized payment method to purchase travel products from Suppliers on your behalf.

All payments for travel are due prior to departure according to each Supplier’s terms and conditions. You acknowledge that failure to make final payment or any violation of a Supplier’s terms and conditions may result in cancellation of your booking or being denied access to the Supplier’s travel services.

You understand travel services are subject to supplemental price increases that may be imposed after the date of purchase. Post-purchase price increases may be applied due to additional costs imposed by a Supplier or government, including increased fees, fuel surcharges, taxes, fluctuations in foreign exchange markets, or any combination thereof. If a price increase occurs, we will request authorization for an additional payment for such additional amounts.

Depending on Supplier’s terms and conditions, you may be entitled only to a partial refund or no refund at all if you change or cancel your travel bookings after confirmation. You are responsible for reading and understanding each Supplier’s terms and conditions. 

If you decide to change any portion of your confirmed arrangements prior to departure or during your trip, we will make reasonable efforts to assist you. Certain bookings may not be able to be changed. All change and cancellation requests must be sent to Second Star in writing. Suppliers’ policies, including penalties and change fees, may apply to any changes and cancellations. Suppliers’ penalties, change fees, or other fees will be charged to the payment method you authorized to pay for that Supplier’s travel services or deducted from any refund provided by the Supplier. Any excess refund will be applied to the payment method you authorized to pay for that Supplier’s travel services.

The Supplier may determine that alterations in itinerary are necessary for any number of reasons, including but not limited to severe weather. Any alterations to an itinerary are at the sole discretion of the Supplier, and Second Star bears no responsibility for any changes.

Currency exchange rates fluctuate. Prices are subject to change based upon currency exchange rate fluctuations. Second Star is not responsible for surcharges or foreign transaction fees imposed by your credit card or bank.

Except in cases of actual fraud, you agree not to file any dispute with your payment method or any affiliated bank or other institution. You agree not to file any such dispute for the purpose of avoiding the Terms and Conditions or any of Suppliers’ terms and conditions, including change and cancellation policies. If you attempt to charge back, reverse, or otherwise undo a previously authorized and completed payment without the consent of Second Star, you will indemnify and hold harmless Second Star from any additional costs, fees, and expenses incurred as a result, including, without limitation, reasonable attorney fees. 

4. Travel Documents, including Identification Requirements

You are responsible for obtaining and carrying all necessary identification documents with you during your travel, which may include valid passport, visa(s), photo ID, or REAL ID, for each member of your traveling party, including children and infants. You are responsible for confirming with all Suppliers, as well as applicable domestic and foreign government authorities, what documents are necessary for your travel. Second Star is not responsible for any losses, including missed travel and/or cancellation or rebooking costs, resulting from the failure to possess necessary documents.

We strongly recommend that you review all identification document requirements as early as possible, to leave sufficient time to obtain or renew any necessary documents. Please note that documentation requirements may change on a daily basis.

You should receive your travel documents, including tickets and vouchers for travel services, no later than 10 days prior to your departure date. Please review these documents immediately upon receipt and notify us as soon as possible, and in any event within 24 hours, of any errors. Second Star is not responsible for any errors made by Suppliers. Please note that airline boarding passes may be obtained at the time of check-in.

Air Travel

Acceptable identification to board flights from U.S. airports can be found at  http://www.tsa.gov/traveler-information/acceptable-ids. The name, date of birth and gender that appears on each traveler’s identification card must exactly match what appears on traveler’s airline ticket(s) and booking records. Requirements for boarding flights from non-U.S. airports may vary. You acknowledge that any failure to strictly comply with these requirements may result in delayed or denied boarding. 

International Travel

A valid passport is required for all international travel. Note that certain countries will not allow a traveler to enter if their passport expires within six (6) months of the anticipated date of return. Non-United States citizens may require additional documentation. You are responsible for informing Second Star of any members of your traveling party who will be traveling on a passport from a country other than the United States of America.

Note that while a passport card may be valid identification to board a U.S. domestic flight, it is not valid identification to board an international flight from the U.S. - a valid passport book is required.

Minors, including children and infants, also require their own passport to travel internationally. Minors traveling with one parent, or with adults who are not their parents, may require additional documents and/or consents; see https://www.usa.gov/travel-documents-children.

Visas are required for travel to certain countries, and visa requirements may differ based on the nationality of the traveler. Second Star does not control or warrant the issuance of visas or approval of visa waivers related to your travel. Second Star is not responsible for any losses resulting from non-issuance of a visa for any reason.

Certain countries may restrict entry for individuals with a criminal history. Second Star will not collect information about criminal history. You are responsible for confirming that all members of your traveling party are allowed to travel to all your travel destinations.

5. Health and Safety Concerns

Certain destinations may require specific immunizations, health screenings, and/or documentation of the same prior to travel. You are responsible for obtaining any necessary immunizations and screenings for your traveling party prior to travel, and providing any necessary documentation to the relevant authorities. Second Star recommends that you check with your healthcare provider before booking if you have any concerns about necessary immunizations. The U.S. State Department (http://travel.state.gov) and the Centers for Disease Control (http://wwwnc.cdc.gov/travel/) maintain information for travelers.

Aerosol disinfection of incoming and/or outgoing aircraft is required by certain countries to protect public health, agriculture and the environment. The U.S. Department of Travel maintains a list of countries with disinfection requirements at https://www.transportation.gov/airconsumer/spray. Second Star recommends that you check with your airline if you have any concerns about aerosol disinfection.

You understand that travel arrangements may be interrupted or canceled by Suppliers, government entities, or other third parties outside Second Star’s control for reasons that are unforeseeable at this time. You also understand that travel involves risks to health and safety, including but not limited to injury, illness, and death. You understand and agree that you assume all such risks whether or not specified herein. Second Star does not represent or warrant that travel is advisable or without risk, and shall not be liable for costs, damages or losses that may result from travel to any destination.

Travel to certain destinations may involve greater risk than others. You are responsible for keeping aware of any health or safety advisories that may affect your travel. The U.S. State Department maintains a current list of travel advisories at https://travel.state.gov/content/travel/en/traveladvisories/traveladvisories.html/

6. Travel Procedures

You are responsible for arriving at all travel services in a timely fashion, taking into account travel time and any pre-travel security procedures. Failure to arrive on time may result in your being denied entry to flights, cruises, excursions, or other travel services, and you may be ineligible for any refund. For airline travel, Second Star strongly recommends that you check in a minimum of 2 hours prior to scheduled departure for domestic flights and 3 hours prior to scheduled departure time for international flights. You should reconfirm flight times with your airline at least 24 hours prior to scheduled departure time for domestic flights, and 72 hours prior for international flights. Second Star is not responsible for any losses resulting from arriving late to flights, cruises, excursions, or any other travel services, for any reason.

Airline seat assignments are not guaranteed, and Second Star has no control over airline seat assignments. Many airlines charge a fee to prebook seats, and many airlines charge extra fees for certain seats within a cabin.

You are responsible for packing your luggage and carry-on bags. You are responsible for following all relevant regulations and guidelines on items that are forbidden to bring with you on your travel. The TSA maintains a list of prohibited items for airline travel originating in the U.S. at http://www.tsa.gov/traveler-information/prohibited-items. Other modes of travel, including cruise lines, may have different restrictions. Second Star recommends that you check each Supplier’s list of restrictions prior to travel. 

Some medications are banned from certain countries, or require special authorization. If you are planning to bring medication with you on international travel, you should consult the destination country’s embassy for information on restrictions. The Centers for Disease Control maintains a helpful website at https://wwwnc.cdc.gov/travel/page/travel-abroad-with-medicine

7. Airline Ticketing

Your airline ticket is a contract between you and the air carrier, whether or not Second Star facilitates the purchase. You acknowledge and agree that Second Star does not have the right or ability to control the operations of independent airlines, and you agree that Second Star is not liable for any personal injury or property damage related to your purchase of airline tickets, including but not limited to any act, error, omission, injury, loss, accident, or delay caused by any act, error or omission of the airline, including their failure to deliver services, partial or inadequate delivery of services, airline policies including refund or rebooking policies, fees for checked or carry-on luggage, fuel increases, bankruptcy or cessation of operations. Second Star is not responsible for any airline schedule changes.

You understand and agree that Second Star is not a ticketing agent for any airline, and that Second Star does not handle or hold client funds for airline tickets. You agree that Second Star is not the merchant of record as that term is defined in 14 CFR 260.2. You understand that any refund for canceled or delayed flights, baggage fees or seat assignments must come directly from the airline and not from Second Star.

Failure to use a reservation may result in automatic cancellation of all continuing and return flights, as well as forfeiture of airfare.

8. Offers Subject to Availability

All offers, incentives and Supplier promotions are subject to availability and may change without notice. Second Star recommends that you reserve early to avoid disappointment, increases in fares and additional late booking fees. Second Star reserves the right to correct any errors, including pricing errors and omissions.

9. Limitations of Responsibility

You agree that Second Star is not responsible for any personal injury or property damage arising from any travel services. Second Star disclaims any liability, whether based on contract, tort, strict liability, or otherwise, including without limitation liability for direct, punitive, special, consequential, incidental, or indirect damages, in connection with the goods or services provided by any Supplier booked through Second Star, including without limitation liability for any act, error, omission, injury, loss, accident, delay, or irregularity which may be incurred through the fault, negligence, willful acts or omissions or otherwise of such Supplier, or of any Supplier or their respective employees, agents, servants, or representatives, including without limitation, their failure to deliver or their partial or inadequate delivery of services, their cancellation and refund policies, fuel price increases, bankruptcy or cessation of operations, and other matters outside Second Star’s control, and you hereby exonerate Second Star from any liability with respect to the same.

10. Fee Disclosure/Limitation of Liability

SECOND STAR HAS SOLELY RECEIVED COMMISSION AND FEES FOR TRAVEL TRANSACTIONS AND YOU AGREE AND UNDERSTAND THAT ANY RECOVERY FROM SECOND STAR UNDER ANY CIRCUMSTANCE WILL BE LIMITED TO THE AMOUNT OF COMMISSION AND FEES ACTUALLY RECEIVED BY SECOND STAR.

11. Force Majeure

Second Star will not be in breach of these Terms and Conditions or otherwise be liable to you, for any failure or delay in performing an obligation that is due to any of the following causes, to the extent beyond its reasonable control: acts of God, accident, riots, war, terrorist act, epidemic, pandemic, quarantine, civil commotion, breakdown of communication facilities, including web host and internet service provider, breakdown or malfunction of equipment, destruction of or serious damage to facilities, natural catastrophes including, but not limited to extreme weather events, floods and volcanic eruptions, governmental acts or omissions, changes in laws or regulations, national strikes, fire, explosion, generalized lack of availability of raw materials or energy, and any other unforeseen circumstance which is beyond the control of Second Star. SECOND STAR STRONGLY RECOMMENDS THAT YOU PURCHASE TRAVEL INSURANCE ON ALL TRIPS. 

In addition, each Supplier’s terms and conditions include Force Majeure provisions. In the event that a Force Majeure event occurs, those Suppliers may be entitled to, and may in their sole and absolute discretion, vary, postpone or cancel any itinerary or arrangement in relation to the trip. Payment of any refund to you as a result of the non-performance of any obligations hereunder shall remain in the sole and absolute discretion of the Supplier, pursuant to their policies, although Second Star shall use its reasonable efforts to secure reimbursement for you where possible.

12. Travel Insurance

Second Star offers access to supplemental travel insurance to protect you in the event of adverse circumstances. Unless expressly noted, travel insurance is not included in your booking, and you are not protected in the event of travel delay, cancellation, interruption, medical emergencies, lost baggage, death and disability, and more. Supplemental travel insurance may protect you in these situations.

You understand that, without insurance, if any portion of the travel is canceled for any reason, you may not receive a refund, and Second Star’s and Suppliers’ cancellation policies will apply resulting in loss up to the full cost of travel and related expenses.

You are not obligated to purchase travel insurance. If you choose not to purchase travel insurance, Second Star will require you to execute a waiver of insurance coverage.

Second Star is not a licensed insurance broker, and we cannot answer technical questions about benefits, exclusions, and conditions of the travel insurance offered. Second Star cannot evaluate the adequacy of your existing insurance coverage. You should contact your insurer for any questions about coverage.

Second Star does not guarantee that any insurance provider will approve any claims made under the insurer’s policy, and Second Star makes no representations about the extent of coverage for any policy it may offer or quote.

13. California Residents

This term applies to California residents:

Upon cancellation of the transportation or travel services, where the passenger is not at fault and has not canceled in violation of any terms and conditions previously clearly and conspicuously disclosed and agreed to by the passenger, all sums paid to the seller of travel for services not provided will be promptly paid to the passenger, unless the passenger advises the seller of travel in writing, after cancellation. This provision does not apply where the seller of travel has remitted the payment to another registered wholesale seller of travel or a carrier, without obtaining a refund, and where the wholesaler or provider defaults in providing the agreed-upon transportation or service. In this situation, the seller of travel must provide the passenger with a written statement accompanied by bank records establishing the disbursement of the payment, and if disbursed to a wholesale seller of travel, proof of current registration of that wholesaler. 

Second Star is not a participant in the California Travel Consumer Restitution Fund.

14. Reservation of Rights

Second Star reserves the right, in our sole discretion, to change these Terms and Conditions at any time. Updated versions of the Terms and Conditions will be provided to Clients, will be posted on our website and will be effective immediately on posting.

15. General Terms

The laws of the State of New York govern these Terms and Conditions. You hereby consent to the exclusive jurisdiction and venue of courts in Kings County, New York in all disputes arising out of or relating to travel bookings with Second Star.

If any part of these Terms and Conditions is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and agreement shall continue in effect.

These Terms and Conditions (and any other terms and conditions referenced herein) constitute the entire agreement between the Client and Second Star with respect to travel bookings made with Second Star by any means, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between Client and Second Star. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms and Conditions to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
